Alec Baldwin Is Sticking To His ‘Rust’ Story Despite FBI Report

Actor Alec Baldwin and his attorney are pushing back against the FBI’s recent report that the “30 Rock” actor had to have pulled the trigger in the fatal “Rust” shooting that took the life of cinematographer Halyna Hutchins and injured director Joel Souza.

In a new interview that was released on Tuesday, Baldwin sat down with former CNN news anchor Chris Cuomo, to discuss the shooting. Baldwin recalled that there was a lot of “confusion” on set after the shooting and made it clear that he is “not the victim.”

In the video interview, which can be seen above,  Baldwin insists that he’s “not the victim.” He said, “things for me are going to get better” and going to get “cleared up.” He expressed sympathy for Halyna Hutchins’ son, who will now grow up without his mother. “Nothing’s going to bring her back,” he said. “She died.”


He said that “everything we said doesn’t matter,” referring to both himself and the press. He said that his behavior has been “consistent” and said he’s “never had one problem in all my years in making movies,” even when he was filming scenes with guns for other movies.

Cuomo said that he believed Baldwin when he said he wasn’t a victim. When asked how he handles the situation, Baldwin thanked his “very supportive spouse,” Hilaria Baldwin, who is currently pregnant with their seventh child.


Even though Baldwin stuck to his story and insists he didn’t pull the trigger on set, a new FBI report – which was released after the interview was recorded, it seems – reveals that he had to have pulled the trigger in order to discharge the gun.

In a statement to Fox News on Monday (via TMZ), Baldwin’s attorney, Luke Nikas, said that the FBI’s report released by ABC News “is being misconstrued.”


“The gun fired in testing only one time — without having to pull the trigger — when the hammer was pulled back and the gun broke in two different places,” Nikas said. “The FBI was unable to fire the gun in any prior test, even when pulling the trigger, because it was in such poor condition.”


The FBI conducted accidental discharge testing on the model of firearm used in the shooting, a .45 Long Colt caliber F.lli Pietta single-action revolver. The report stated that the gun “could not be made to fire without a pull of the trigger” with the hammer in the quarter and half-cock positions.

With the hammer fully cocked, the FBI says the gun “could not be made to fire without a pull of the trigger while the working internal components were intact and functional.”


The report continued to explain that, with the hammer de-cocked on a loaded chamber, the gun was able to detonate a primer “without a pull of the trigger when the hammer was struck directly,” which is reportedly normal for this type of revolver.

A postmortem report obtained by ABC News around the same time of the FBI report shows that the New Mexico Office of the Medical Investigator has classified Hutchins’ death as an accident.


“Death was caused by a gunshot wound of the chest. Review of available law enforcement reports showed no compelling demonstration that the firearm was intentionally loaded with live ammunition on set,” the report says. “Based on all available information, including the absence of obvious intent to cause harm or death, the manner of death is best classified as accident.”

Nikas said that the “critical report” in this case is “the one from the medical examiner, who concluded that this was a tragic accident.” He continued to defend his client, saying, “This is the third time the New Mexico authorities have found that Alec Baldwin had no authority or knowledge of the allegedly unsafe conditions on the set, that he was told by the person in charge of safety on the set that the gun was ‘cold,’ and believed the gun was safe.”


The latest reports have been sent to the Santa Fe police department, which has yet to file criminal charges against anyone in the fatal “Rust” shooting.
