Kim Zolciak-Biermann DENIES Her Daughter Was Under The Influence After Arrest

Kim Zolciak-Biermann refuses to be tardy to her daughter’s DUI party.

The reality TV star has broken her silence on her 20-year-old daughter’s recent DUI arrest.

Ariana Biermann was arrested this month after her involvement in a car crash. She has vehemently denied drinking or being under the influence before the car accident.

Kim Zolciak Breaks Her Silence On Daughter’s DUI Arrest

At the time of the crash and subsequent arrest, her lawyer, Justin Spizman, said, “Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI. Despite Ariana’s constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol. That was not the case. She wholly denies these allegations and intends to fight these charges because she is not guilty of them.”

Her mom echoed a similar sentiment on her Instagram Story on Tuesday, August 16.

“Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI of Alcohol,” her Story read. “Despite Ariana’s constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired. That was not the case. While we have no further desire to litigate this case in the media, Ariana was not impaired by any substance, including alcohol or marijuana.”

Kim Denies Her Daughter Was Intoxicated

Kim’s message continued, “Since she was being cooperative and honest, she admitted to consuming marijuana the day before, meaning over 24hours prior to her contact with law enforcement. In addition, the arresting officer, as evidenced by his own police report, charged Ariana with impairment by alcohol. She wholly denies these allegations and intends to fight these charges because she is not guilty of them. Thus, we appreciate the general public allowing this case to be tried on its merits, and not rhetoric or incorrect conclusions.”

Ariana refused to take a breathalyzer test at the time of her arrest.

In a police report obtained by PEOPLE, Ariana was driving a black Mercedes G-Wagon when she was involved in a collision with another car around 1 a.m. on Sunday in Atlanta. She was then arrested and cited with a DUI.

The arresting officer claims that he smelled alcohol on her breath, despite her denial of consuming any alcoholic beverage before the crash.

Ariana admitted to smoking a THC vape pen the night before, which the officer recovered from her bag, according to the police report.

The officer also noted in the report that she “had a noticeable sway” during the field sobriety test.

Ariana Was Swaying & Had Turned Down Breathalyzer Test

The officer also observed “four out of six clues” that she was intoxicated after undergoing the horizontal gaze nystagmus evaluation.

The legal blood alcohol limit while driving is .08 in the USA.
